These Terms of Service apply to use of Filacorp’s website and online services.
They do not replace the Terms and Conditions of Sale, which govern the sale and purchase of goods.
In the event of conflict:
a. the Terms and Conditions of Sale apply to product orders, payment, delivery, risk, title, warranty, B2B/B2C sales, and liability for goods;
b. the Returns and Refunds Policy applies to returns, refunds, withdrawal rights, inspections, and defective goods;
c. the Privacy Policy applies to personal data; and
d. these Terms of Service apply to website access, online accounts, website content, user conduct, and online service use.
4. B2C and B2B Users
These Terms apply to both B2C and B2B users.
A B2C user is a consumer using the website or purchasing for purposes outside their trade, business, craft, or profession.
A B2B user is a business, company, trader, organisation, reseller, institution, school, maker space, manufacturer, or other professional or commercial user.
Nothing in these Terms excludes or limits mandatory B2C rights under Maltese or EU consumer law.

Product images, colours, previews, renders, sample prints, and photographs are illustrative only. Actual filament colour, finish, opacity, texture, and print results may vary due to batch variation, monitor settings, printer settings, material behaviour, lighting, humidity, and customer handling.
8. Product Information Online
Product information on the website is subject to change without notice before order acceptance.
Filacorp may update specifications, prices, packaging, spool design, formulations, recommended print settings, drying recommendations, product descriptions, stock availability, and technical information.
Where you place an order, the order is governed by the Terms and Conditions of Sale in force at the time Filacorp accepts the order, unless otherwise required by law.
9. Prices, Stock and Errors
Prices, promotions, discounts, and stock information shown on the website are subject to change.
Filacorp may correct errors in pricing, VAT, stock availability, product descriptions, shipping charges, promotions, discount codes, technical information, or checkout calculations.

B2B Customers are also responsible for checking product suitability for their printer, production process, customer use, resale, manufacturing, and intended commercial application.

For B2C online purchases, Filacorp will provide required consumer information before purchase where applicable, including trader identity, product information, pricing, delivery charges, payment information, returns information, withdrawal rights, and legal guarantee information.
B2C online customers may have a 14-day withdrawal right for distance or off-premises purchases, subject to applicable exceptions and conditions. EU and Malta-facing consumer guidance describes this cooling-off period as applying to distance contracts such as online purchases.

14. User-Submitted Information

B2B users agree to indemnify Filacorp against claims, losses, liabilities, damages, costs, expenses, and third-party claims arising from:
a. misuse of the website;
b. breach of these Terms;
c. unlawful use of website content;
d. unauthorised use of Filacorp’s intellectual property;
e. fraudulent or misleading account activity;
f. cyber misuse, scraping, or unauthorised access attempts; or
g. misuse by employees, agents, contractors, or persons using the B2B user’s account.
27. Changes to the Website

These Terms of Service are governed by the laws of Malta.
The parties shall first attempt to resolve disputes amicably.
Subject to mandatory consumer rights and applicable law, disputes shall be submitted to the competent courts of Malta.
For B2C Customers, nothing in these Terms deprives consumers of mandatory rights to bring claims in the courts or forums available under applicable consumer protection law.
